国際基督教大学教養学部卒。ニューヨーク州立大学バッファロー校哲学博士課程修了。博士(哲学)。東京大学大学院医学系研究科特任助教等を経て、現職。専門は倫理学、生命倫理。日本生命倫理学会若手論文奨励賞、日本倫理学会和辻賞、日本医学哲学・倫理学会学会賞を受賞。日本生命倫理学会理事、日本医学哲学・倫理学会理事。横浜労災病院倫理委員会、慶応大学医学部倫理委員会で外部委員。主な著書に『死ぬ権利はあるか』(春風社、2019年)など。

    The "dead-donor rule" states that, in any case of vital organ donation, the potential donor should be determined to be dead before transplantation occurs. In many countries around the world, neurological criteria can be used to legally determine death (also referred to as brain death). Nevertheless, there is considerable controversy in the bioethics literature over whether brain death is the equivalent of biological death. This international legal review demonstrates that there is considerable variability in how different jurisdictions have evolved to justify the legal status of brain death and its relationship to the dead-donor rule. In this article, we chose to review approaches that are representative of many different jurisdictions-the United States takes an approach similar to that of many European countries
    the United Kingdom's approach is followed by Canada, India, and influences many other Commonwealth countries
    Islamic jurisprudence is applicable to several different national laws
    the Israeli approach is similar to many Western countries, but incorporates noteworthy modifications
    and Japan's relatively idiosyncratic approach has received some attention in the literature. Illuminating these different justifications may help develop respectful policies regarding organ donation within countries with diverse populations and allow for more informed debate about brain death and the dead-donor rule.

    In moral discourse, people often appeal to emotion as opposed to reason. This is particularly true when they discuss the moral status of the use of new biomedical technology. Sometimes we may be unable to articulate an argument against organ transplantation from a brain-dead person, host surrogacy, human embryonic stem cell research, etc; we may then only say that "these acts are disgusting." What exactly do we mean when we say that someone's act is "disgusting"? In the first half of this paper, I shall distinguish three cases: (1) a person who seeks to reach a "reflective equilibrium;" (2) a communitarianist; and (3) a moral realist, each of whom may appeal to emotions in his or her own way. The purpose of the latter half of the paper is to examine and refute the manner in which moral realists appeal to emotion. Consider, for example, incest, cannibalism, rape and murder. It may seem that these acts are objectively evil, and that they provoke a negative emotional reaction. These facts might lead one to believe a realistic idea that human beings are biologically equipped with a special kind of emotion whose function is to detect objectively existing moral evilness. In order to show a fallacy involved in this inference, I shall point to a fact that has been reported in the literature of empirical psychology.

    This paper discusses certain basic issues concerning patients who have irreversibly lost sentience and consciousness (including brain-dead patients and some PVS patients). Current literature fails to give a satisfactory account of the validity of these patients' advance directives and the basis for justifying their families' proxy decision-making. The purpose of this paper is to demonstrate that, in the context of giving justification for laws and policies, 'interest' needs to be understood as a concept that only denotes the phenomena of one's sentient or conscious experiences (e.g., comfort and pleasure). Therefore, 'laws protect the interest of a person whose cerebrum has irreversibly lost all functionality' should mean merely that 'there are some established legal measures by recourse through which the person could have enjoyed a sense of relief concerning organ donation or life sustaining treatment, prior to the loss of cerebral functioning, knowing that it is promised that his or her wish will be honored.' Such legal measures include the provision that a person's wish expressed in an advance directive will always be honored. I shall argue against the trend of the current literature in which it is almost taken for granted that a brain-dead person or a PVS patient has a legally protectable interest in the fulfillment per se of the wish that the patient had before losing consciousness. My position is that when a patient has lost sentience and consciousness without leaving an advance directive, the family's proxy decision-making cannot be justified on the basis that it protects the patient's interest.

    これらの論文では、主として、(A)いわゆる積極的安楽死などの積極的な行為による生命短縮(致死薬の投与)といわゆる間接的安楽死と呼ばれるタイプの行為(鎮痛剤や鎮静剤の多量投与)の間に倫理的な区別をつけることができるか、一方だけを許容して他方を許容しないという立場は正当化できるかの問題、または、(B)鎮静剤の投与が患者に及ぼす影響に関して、従来からよく倫理的問題が指摘されてきた生命短縮のリスクだけでなく、完全な意識喪失や、意識低下についても問題視されるようになってきたことを踏まえて、これらの影響をそれぞれどのように倫理的に評価するのがよいか、という問題のふたつを扱った。
    この他に、薬学部の学生向けにかかれた教科書の分担執筆を行った。ここでは、とくに終末期医療の倫理に関して、基本的な倫理問題の整理と各国地域の政策の内容をまとめた。
    また、依頼を受けて、3冊の書籍(主題はそれぞれナチスドイツの安楽死計画、京都ALS嘱託殺人事件、生体臓器移植)に関する書評を執筆した。

    I conducted (1) literature review, (2) published articles, and (3)published a few book reviews. In the literature review, I collected and carefully read recent literature on the ethics concerning the use of life-sustaining treatment. Two papers were published during the last fiscal year, and one is scheduled for publication (as a co-author of a book) in the next fiscal year. In addition, I am also preparing a paper for submission. In addition, I published reviews of three books (on the subjects of Nazi Germany's euthanasia program, the Kyoto ALS commissioned murder case, and living organ transplants).

    I have written and published multiple journal articles and book chapters regarding the possible demerits of the legalization of passive euthanasia. Plausibility of the claim that vulnerable populations needs to bear the risks of being pressured to accept death when passive euthanasia becomes legalized, was investigated. Also, plausibility of the idea that a person's existence has intrinsic value so that it can be wrong to destroy a person's life even when s/he both wants to die and has no interest in stay alive, was explored.

    The purpose of this study is to identify conditions for establishing effective interdisciplinary collaboration among healthcare professionals by focusing on organization, role recognition, professional ethics. Furthermore, this study gives empirical evidence on nursing management issues on education and systematization for effective interdisciplinary collaboration. We conducted: (1) an interview on professionalism and institutionalization perceived by each professional in the palliative care team, (2) a visit overseas for studying the current status of interdisciplinary collaboration, (3) preparing a collection of cases and learning materials for studying professional ethics, (4) holding a public lecture on professionalism and ethics education.

    The topic of the research was ethics of passive euthanasia. In particular, the validity of so-called non-consequentialist approach (which denies that morality of actions should be evaluated solely on the basis of their consequences) to the issue was explored. The major findings of the study includes that a certain type of argument appealing to the intrinsic value of persons in criticism of euthanasia can be defended against the charge that the argument has some absurd implications when applied to clinical cases.
